Photo & Video Release Agreement

PHOTO & VIDEO RELEASE AGREEMENT

Duncans Mills Candle Co.
Including: Après Fragrance & Atelier Fragrance Bar

By booking and/or participating in any fragrance blending experience, workshop, class, private event, or in-store activity hosted by Duncans Mills Candle Co., Après Fragrance, or Atelier Fragrance Bar (collectively referred to as “the Company”), you acknowledge and agree to the following:

1. Grant of Permission

You grant the Company the irrevocable right and permission to photograph, film, record, and otherwise capture your image, likeness, voice, appearance, and/or presence during any experience or activity taking place at the shop, studio, event space, or affiliated locations.

2. Use of Images & Recordings

You agree that these photographs, video recordings, and audio recordings may be used by the Company, without limitation, for lawful business purposes, including but not limited to:

  • Marketing and advertising

  • Social media content

  • Website and online shop content

  • Email marketing and newsletters

  • Printed materials, signage, brochures, and displays

  • Press, editorial, and promotional features

  • Educational or instructional materials

This use may occur in perpetuity and across all media formats now known or later developed.

3. Ownership & Compensation

You understand and agree that:

  • All images and recordings are the sole property of the Company

  • You waive any right to inspect or approve the finished materials

  • You will not receive compensation, royalties, or payment for the use of your image or likeness

4. Release of Liability

You release and hold harmless the Company, its owners, employees, contractors, affiliates, and partners from any claims, demands, or liability arising from the use of such images or recordings, including claims related to privacy, publicity, or defamation.

5. Minors

If a participant is under 18 years of age, booking and participation must be completed by a parent or legal guardian, who consents to this release on the minor’s behalf.

6. Opt-Out (On-Site Courtesy)

If you prefer not to be photographed or recorded, you are welcome to notify staff upon arrival. While the Company cannot guarantee exclusion from all incidental background imagery, reasonable efforts will be made to accommodate requests.

7. Agreement & Acceptance

By booking an experience, purchasing a ticket, or participating in any event or activity with the Company, you confirm that you have read, understood, and agreed to this Photo & Video Release Agreement.
